Terms of Service

1. Acceptance of Terms

By accessing and using BuyNearMe ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

BuyNearMe is operated by BuyNearMe India Pvt. Ltd. and is available in Jammu & Kashmir. These terms are governed by the laws of India.

2. User Accounts

Eligibility

• You must be at least 18 years old to create an account
• You must provide accurate, truthful information during signup
• You are responsible for maintaining the confidentiality of your password

Account Responsibility

You are solely responsible for all activity on your account. If you suspect unauthorized access, notify us immediately at support@buynearme.in.

Account Termination

We may terminate your account at any time, without notice, if we determine you have violated these terms or engaged in fraudulent, abusive, or harmful activity.

3. User Conduct & Prohibited Activities

You agree not to:

• Post false, misleading, or defamatory content about any business or person
• Use the Service to spam, harass, or abuse others
• Attempt to hack, reverse-engineer, or bypass security measures
• Scrape, copy, or download bulk data without permission
• Upload malware, viruses, or malicious code
• Impersonate another person or business
• Post adult, graphic, or illegal content
• Engage in unauthorized commercial activity or resale
• Violate any applicable laws or regulations in India

Violation of these rules may result in immediate account suspension or termination.

4. Business Listings & Content

Listing Guidelines

• Accuracy: All listing information must be accurate and current. Update hours, contact, and address regularly.
• Authenticity: Photos must be of the actual business. Stock images are not permitted.
• No Spam: Do not use descriptions or photos to advertise unrelated services or solicit customers outside the platform.
• Compliance: Ensure your business complies with local and national laws, including GST registration, trade licenses, etc.
• No Multi-Listings: Create only one listing per business location. Duplicate or spam listings will be removed.

Content Ownership

You retain ownership of your listing content. By posting it, you grant BuyNearMe a worldwide, royalty-free license to display, reproduce, and distribute it on the Service and related marketing materials.

Moderation & Removal

BuyNearMe administrators review all new listings before they appear publicly. We may reject, edit, or remove listings that violate these terms or contain false information. You will receive email notification of any action taken.

5. Featured Listings & Payments

Featured Listing Orders

• Pricing: Featured listing prices are set in INR and displayed at checkout. Prices are subject to change with notice.
• Duration: Featured status is active for the duration purchased (7, 14, or 30 days) and applies to the specified placement (homepage, city, or category page).
• No Refunds: All featured listing purchases are non-refundable. If your listing is suspended or deleted during the feature period, no refund is issued.
• Automatic Expiry: Featured status automatically expires at the end of the paid period. We do not charge for renewal unless you explicitly request it.

Razorpay Payment Processing

• Payments are processed by Razorpay, a third-party payment provider. By making a payment, you agree to Razorpay's terms and conditions.
• BuyNearMe does not store your card, UPI, or bank details. Razorpay securely handles all payment information.
• Payment confirmation is sent via email. If you do not receive it within 2 hours, contact support@buynearme.in.
• If a payment fails, you will see an error message. Do not attempt the transaction multiple times — this may result in duplicate charges. Refunds for duplicate charges are processed within 5–7 business days.
• Disputed charges must be raised with Razorpay, not BuyNearMe. Contact Razorpay Support.

Taxes

Featured listing prices include GST (Goods and Services Tax) as applicable. Invoices are sent to your registered email address.

6. Reviews & Ratings

Users may submit reviews and ratings for businesses. All reviews are subject to moderation and must:

• Be based on genuine customer experience
• Not contain harassment, threats, or false accusations
• Not include contact information, URLs, or promotional content
• Not violate the privacy of the business or other customers

BuyNearMe reserves the right to reject or remove reviews that violate these guidelines. Ratings are calculated as the average of all approved reviews.

7. Intellectual Property

All BuyNearMe logos, branding, design, and non-user content are owned by BuyNearMe or its licensors. You may not use, reproduce, or distribute them without permission.

User-submitted content (listings, photos, reviews) remains your property, but you grant BuyNearMe a perpetual license to display and promote it on the Service.

8. Disclaimers & Limitation of Liability

Disclaimers

BuyNearMe is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of business information, reviews, or ratings
• Quality of products or services provided by listed businesses
• Protection against fraud, misrepresentation, or theft by users

BuyNearMe is a directory only. We do not endorse any business and are not responsible for disputes between customers and businesses.

Limitation of Liability

To the maximum extent permitted by Indian law, BuyNearMe shall not be liable for:

• Loss of data, revenue, or business interruption
• Indirect, incidental, or consequential damages
• Actions or inactions of third parties, including listed businesses
• Hacking, data breaches, or security breaches beyond our reasonable control

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.

Informal Resolution

If you have a dispute, contact us at support@buynearme.in with details. We will attempt to resolve it within 15 days.

Legal Proceedings

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of courts in Jammu & Kashmir, India. You agree to submit to such jurisdiction.

10. Indemnification

You agree to indemnify and hold harmless BuyNearMe, its owners, and employees from any claims, damages, or costs arising from:

• Your violation of these Terms
• Your use of the Service
• Your listing content or user-generated content
• Your violation of third-party rights or applicable law

11. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the site. Continued use of the Service after changes constitutes acceptance.

12. Termination

We may terminate your access to the Service immediately and without notice if you violate these Terms or engage in illegal or harmful activity.

Upon termination, your right to use the Service ends immediately. Sections that by their nature are meant to survive (liability limitations, indemnification, etc.) shall continue.
